TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the EB-2 NIW Appeals application, website, and related services (the “Service”). The Service is operated by Oscar Pardo Consulting SLU (“Company”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Important disclaimers (not legal advice)
We are not a law firm and do not provide legal services. The Service provides informational tools, including summaries, comparisons, and search results related to EB-2/AAO decisions and user-uploaded documents. Nothing on the Service constitutes legal advice, and no attorney-client relationship is created. You should consult a licensed attorney for legal advice.
2) Government sources + possible errors
Some case documents and metadata are retrieved from official U.S. government sources (including USCIS and the Administrative Appeals Office). We may process those documents to create summaries, extract structured data, or display search results. Automated processing can produce errors, omissions, or inaccuracies. You are responsible for verifying important details against the original source document.
3) Eligibility
You must be able to form a legally binding contract in your country (and meet any minimum age requirements that apply to you). By using the Service, you confirm you meet these requirements.
4) Accounts and access
You may need to sign in to use parts of the Service.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must provide accurate information and keep it updated.
5) Acceptable use
You agree not to:
Use the Service for unlawful purposes or to violate any applicable laws or regulations.
Upload content you do not have the right to use or share.
Attempt to reverse engineer, scrape, overload, or disrupt the Service.
Bypass access controls or attempt to access data belonging to other users.
Introduce malware, viruses, or harmful code.
Use the Service to provide legal services to third parties or resell/redistribute outputs without our written permission.
Overload our system. Reasonable use of the platform entails a maximum of 1 RFE/document analysis per day in the “Analyze my case” tool.
6) Uploads and user content
When you upload PDFs or other materials (“User Content”):
You represent that you have the right to upload and process that content.
You understand that the Service will extract text and send text (and/or other derived data) to third-party providers used to operate the Service (see Privacy Policy).
You grant us a limited, non-exclusive license to host, store, process, and display your User Content only as necessary to provide and improve the Service, comply with law, and enforce these Terms.
Do not upload sensitive data you are not comfortable storing in a cloud application. If your document contains highly sensitive personal data, consider redacting it before upload.
7) AI features and limitations
The Service uses automated systems and may use AI models (for example, via the OpenAI API) to summarize documents and identify “similar cases.” AI output may be incorrect and may reflect limitations in the underlying data. You agree that you will not rely on the Service as a substitute for professional advice.
8) Subscriptions, billing, and renewals
If you purchase a subscription:
Payments are processed by Stripe (a third-party payment processor).
Your subscription renews automatically (monthly) unless you cancel before the renewal date.
We do not store your full card details; Stripe handles payment information.
You are responsible for any taxes or duties that may apply.
9) No refunds (except where required)
All sales are final and non-refundable except where required by applicable law.
10) Cancellation and termination
You can cancel your subscription through the method provided at checkout (Stripe customer portal or link we provide).
If you cancel, you will generally retain access until the end of the current paid period (unless required otherwise by law or due to account misuse).
We may suspend or terminate your access if you violate these Terms, misuse the Service, or if necessary for security, legal, or operational reasons.
11) Personal use only
Outputs and results are intended for personal use. You may not resell, sublicense, publicly redistribute, or publish substantial portions of outputs without our written permission. Consultants or lawyers may not use this platform unless they obtain a professional license from us.
12) Intellectual property
We and our licensors own the Service, including software, branding, design, and non-government content. Government documents may be in the public domain; however, our compilation, presentation, and tooling may be protected.
13) Privacy
Your use of the Service is also governed by our Privacy Policy (see below). By using the Service, you consent to the collection and processing described there.
14) Service availability; changes
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will always be available, error-free, or uninterrupted.
15) Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16) Limitation of liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
Our total liability for any claim related to the Service will not exceed the amount you paid to us for the Service in the 3 months before the event giving rise to the claim (or the minimum amount allowed by law if this limit is not permitted).
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
17) Indemnification
You agree to defend, indemnify, and hold harmless the Company from claims, damages, liabilities, and expenses arising from your use of the Service, your User Content, or your violation of these Terms.
18) Governing law and venue
These Terms are governed by the laws of the jurisdiction where the Company is established, without regard to conflict-of-laws rules. Any disputes will be brought in the courts located in that jurisdiction, unless applicable consumer law requires otherwise.

PRIVACY POLICY + COOKIE NOTICE

This Privacy Policy explains how Oscar Pardo Consulting SLU (“Company”, “we”, “us”) collects, uses, shares, and protects personal information when you use the Service.
1) What we collect
Depending on how you use the Service, we may collect:
A) Account information
Name (if provided)
Email address
Subscription/access flags and plan info within the app
B) Uploaded content
PDFs you upload (e.g., USCIS RFE/NOID/denial letters or related documents)
Extracted text and derived data (summaries, detected criteria, similarity results)
C) Subscription and payment data (via Stripe)
Stripe customer ID and subscription ID
Subscription status, renewal/cancellation indicators, and current period end date
We do not store full payment card details; Stripe processes payment information.
D) Usage and technical data
Basic logs needed to operate and secure the Service (e.g., timestamps, errors, internal identifiers)
Device/browser data may be collected by underlying platforms as part of standard operations
E) Analytics (future)
Currently we do not use analytics tools. In the future we may use Google Analytics or similar. If we do, we will (where required) provide consent controls and update this policy.
2) How we use your information
We use personal information to:
Provide and operate the Service (uploading, processing, displaying results)
Process subscriptions and manage access control
Provide customer support
Maintain security, prevent abuse, and debug issues
Improve the Service (e.g., quality, relevance, performance), including reviewing aggregated or de-identified patterns where possible
Comply with legal obligations and enforce our Terms
3) Legal bases (EU/UK)
If you are in the EU/UK, we process your data under one or more of these legal bases:
Contract: to provide the Service you request
Legitimate interests: to secure, maintain, and improve the Service
Consent: where required (e.g., optional analytics cookies)
Legal obligation: to comply with law
4) How we share information (processors/sub-processors)
We share information only as needed to operate the Service, including with:
Stripe (payments/subscriptions)
Zapier (automation workflows)
OpenAI API (text processing / analysis)
Glide (app platform and data hosting)
Cloud storage and infrastructure providers used by the Service (for example, storage for uploaded files and app databases)
These providers act as processors/sub-processors under contractual terms appropriate for service delivery.
Important: Your uploaded document text may be transmitted to OpenAI and automation tools in order to generate summaries and similar case matches.
5) International transfers
Some providers may process data outside your country (including the United States). Where required, we rely on appropriate safeguards for international transfers (such as contractual protections). By using the Service, you understand that cross-border transfers may occur.
6) Data retention
Uploaded PDFs and extracted/derived data are retained up to 1 year by default, unless you delete them earlier.
Account and subscription records may be retained longer if needed for compliance, accounting, fraud prevention, or dispute resolution.
7) Your choices and rights
A) Self-serve deletion
You can delete your uploads within the app. Deletion may take some time to propagate across systems and backups.
B) EU/UK (GDPR) rights
You may have the right to access, correct, delete, restrict, object, or port your personal data, and to lodge a complaint with your local data protection authority.
C) Canada (PIPEDA) rights
You may request access to your personal information and challenge accuracy or completeness.
D) US (including California)
Depending on your state, you may have rights to access, delete, correct, or opt out of certain uses. We do not sell personal information.

8) Security
We use reasonable administrative, technical, and organizational measures to protect data. However, no system is 100% secure. Please use strong passwords and avoid uploading extremely sensitive information.
9) Children
The Service is not intended for children. Do not use the Service if you are not legally able to consent to data processing in your jurisdiction.
10) Changes to this policy
We may update this Privacy Policy from time to time. We will update the “Last updated” date and, where appropriate, provide additional notice.
